Impact of Marijuana Legalization in the Workplace

Marijuana remains illegal under federal law, but many states have legalized some form of marijuana use. This patchwork of laws creates uncertainties for employers when trying to implement and apply workplace policies. An employer must consider federal laws, such as the Americans with Disabilities Act, and state laws, some of which require an accommodation for medical marijuana or require compliance with certain drug testing procedures. An understanding of the interplay between these laws and how to consistently apply them is critical for an employer to avoid litigation. Attendees of this course will learn:

  • Federal and state marijuana laws and how these affect the workplace
  • Instances in which an employer may be required to accommodate an employee’s use of medical marijuana
  • Recent court decisions regarding marijuana and the workplace
  • Best practices for implementing drug policies
