The Third Circuit reaffirmed that employers can seek civil damages against employees and other individuals who violate the CFAA.

What Happened in Court

The United States Court of Appeals for the Third Circuit ruled that employers can bring a private cause of action against employees seeking monetary and injunctive relief for alleged violations of the Computer Fraud and Abuse Act.  Plaintiffs under the CFAA must demonstrate a that violations occurred “knowingly and with an intent to defraud” and that the intended fraudulent conduct obtained something of value.
