In Brief

The Department of Labor’s Administrative Review Board upheld the dismissal Villanueva’s complaint because he was a foreign national working outside the United States.

What Happened in Court

The ARB found that because Villanueva was a foreign national working at a Colombian subsidiary of Core Laboratories (a Dutch company), SOX did not apply extraterritorially, notwithstanding the fact that the termination decision itself took place in the United States.
