Summary of Filed Complaint

Breeden’s supervisors learned that she had become pregnant, reduced the size of her sales territory, and then terminated her.

What Happened in Court

Breeden was consistently praised as one of Novartis’s top Field Account Representatives.  A few years into her employment, Breeden underwent IVF and eventually became pregnant.  Soon after, management reduced the size of the territory for which she was responsible.  After a judge denied Novartis’s motion for summary judgment, Breeden brought her gender discrimination and FMLA retaliation claims to trial where a jury awarded her $289,669 which was automatically doubled to $579,338.
